We are TransAtlantis Funding Lux S.à r.l. This privacy policy explains how we use any personal information we collect about you when you use this website.

What information do we collect about you?
We collect information about you when you register with us on this website, and also if we contact you to obtain further information about you and any damages claim in connection with the Truck Cartel you wish to discuss with us (a “Damages Claim”). The information we collect includes your name, telephone number, email address and details of the trucks underlying your Damages Claim.

How will we use the information we collect about you?
We use the information we collect about you to process and manage the purchase of Damages Claims, and to pursue those Damages Claims. We are required by law to explain the legal basis for using your information. We use this information because it is necessary for our legitimate interests and the legitimate interests of our affiliates, namely deciding whether to purchase Damages Claims, processing and managing the purchase of Damages Claims and pursuing those Damages Claims.

Who will we share your information with?
We will share your information with our affiliates, and also with third party claims management companies who will assist us in the review, processing and management of Damages Claims and the conduct of any connected litigation.

Where will your information be transferred?
In order to process and manage the Damages Claims, we may transfer your information to our affiliates in the Cayman Islands and in the United States of America, as well as to our third party management partners in Canada. In order to protect your information, the transfers of your information to countries that are not the subject of a finding of adequacy by the European Commission will be governed by a contract between us and each of the entities to which we transfer your information. This contract will be in the standard form prescribed by the European Commission from time to time. You may request a copy of the standard form contract by contacting us at the address below.

How long will we retain your information?
We will retain your information while we are considering whether to purchase any Damages Claims and, if we do, for as long as may be necessary to pursue those Damages Claims and deal with related enquiries and administrative matters (such as making any payment to you that may be due in connection with any Damages Claim).

Access to your information and correction
You have the right to ask us whether we are processing information about you, and if we are, to request access to that information and details of how and why we are processing it. If you would like a copy of some or all of your information, please email or write to us at the address below. You also have the right to ask us to correct information you think is inaccurate, to request that we delete information we hold about you, to request that we restrict the way in which we use your information and to object to how we are using your information. Please note that if you ask us to delete your information or restrict the way in which we use your information, or if you object to how we are using your information, this may affect our ability to pursue your Damages Claim, and this may mean that you lose any entitlement to payment.

Complaints about us
You have a right to make a complaint about our processing of your information to a supervisory authority. Our supervisory authority is the National Commission for Data Protection (Commission Nationale pour la Protection des Données) (CNPD) in Luxembourg.

We keep our privacy policy under regular review and we will place any updates on this website. This privacy policy was last updated on 31 July 2020.
